Using Cartwheel

Cartwheel is a collaborative grocery list app for iOS. We provide it free during the beta. We may change or discontinue features, and we may end the beta and switch to a paid model at any time. We will give reasonable notice before doing either, and your existing data will not be deleted without your consent.

You are responsible for keeping your account credentials safe. If someone else gets access to your account, contact us immediately.

You must be at least 13 years old to use Cartwheel. By creating an account you confirm that you meet this requirement.

Your content

The lists, items, recipes, and other content you create or import into Cartwheel are yours. You can delete any of it any time, and you can delete your entire account from Settings → Delete account.

When you share a list with someone, you grant them the ability to read and write everything on that list — items, recipes, AI suggestions. Either of you can leave the shared list at any time from the list's settings; the list survives with whichever members remain. If you want to remove a specific person you previously added, leave the list yourself, start a new one, and reinvite only the people you want.

AI-generated content

Cartwheel's Discover tab uses Anthropic's Claude API to generate recipe suggestions based on what's in your list, and Google's Imagen API to generate dish photos. These suggestions are model output, labeled with a "✦ Generated by Cartwheel" mark in the app, and:

Food safety is your responsibility. Cartwheel does not warrant that any AI-generated recipe is safe to cook or eat. Always verify cooking temperatures, check for allergens, and use common sense.

Intellectual property and DMCA

The Cartwheel name, mark, and app are our intellectual property. Recipes you import via URL belong to their original publisher; Cartwheel does not claim ownership of imported content. If you believe content on Cartwheel infringes your copyright (e.g., a recipe imported from a site you own), send a notice with the elements required by 17 U.S.C. § 512(c)(3) — your contact info, the work claimed, the URL or location of the alleged infringement, a good-faith statement, and a signature — to hello@cartwheelai.app with "DMCA notice" in the subject. We will respond promptly.

Disclaimers

Cartwheel is provided "as is" and "as available", without warranty of any kind, express or implied, including without limitation any warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that it will meet your specific needs. We do not warrant the accuracy, completeness, or safety of any recipe — imported or AI-generated.

Limitation of liability

To the maximum extent permitted by law, Cartwheel and its operators are not liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of (or inability to use) Cartwheel — including but not limited to loss of data, lost profits, food spoilage, illness from improperly prepared food, or relationship strain over whose turn it is to cook. Our total liability for any claim relating to Cartwheel will not exceed one hundred US dollars ($100) or the amount you paid us in the prior twelve months, whichever is greater.

Governing law

These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-laws principles. The exclusive venue for any dispute that is not subject to arbitration below is the state and federal courts located in San Francisco County, California, and you consent to that venue.

Arbitration and class-action waiver

If you are a resident of the United States, any dispute between you and Cartwheel arising out of or relating to these Terms or the service will be resolved by binding, individual arbitration administered by JAMS under its Streamlined Arbitration Rules, conducted in San Francisco, California (or remotely at your option). The arbitrator's decision will be final and binding. You and Cartwheel each waive any right to a jury trial and any right to participate in a class action, class arbitration, or other collective proceeding. Small-claims court actions in your county of residence are exempt from this clause.

If you do not want to be bound by arbitration, you may opt out by emailing hello@cartwheelai.app with "Arbitration opt-out" in the subject line and your account email in the body, within 30 days of first agreeing to these Terms. Opting out does not affect any other part of these Terms.

This section does not apply where prohibited by law (including for residents of the EU, UK, and certain other jurisdictions).

Severability

If any provision of these Terms is found unenforceable, the rest of the Terms remain in effect. The unenforceable provision will be modified to the minimum extent needed to make it enforceable while preserving its intent.

Changes to these terms

If we make material changes, we will update the "Effective" date at the top and surface a notice in the app. Continuing to use Cartwheel after a change means you accept the updated terms.
